Legislative Authority for Citizens - Amendment to Article I, Declaration of Rights, Florida Constitution

Grants Florida citizens direct legislative authority over all elected officials through three constitutional powers: (1) direct voting on legislation affecting a majority of citizens, (2) authority to task any elected official to create specific legislation, and (3) recall elections for any elected official. Self-executing. Legislature may enact facilitating procedures but cannot restrict these rights.
1. Direct Voting Power
Vote directly on any legislation affecting 51% or more of the population. Your vote is binding on all government entities.
2. Authority to Task Officials
With 30% of voter signatures, you can require any elected official to introduce specific legislation within 60 days. This strong mandate shows significant constituent demand. Failure to comply = grounds for recall (15% threshold).
3. Recall Elections
Remove ANY elected official at ANY level through recall election. 15% petition triggers election within 90 days. Majority vote removes official immediately.
Self-Executing: Takes effect immediately, no waiting for legislature
Supremacy Clause: Overrides ALL conflicting statutes including FL ST 100.361
Floor, Not Ceiling: Legislature can help but CANNOT restrict these rights
Constitutional Protection: Future statutes cannot weaken citizen powers
SECTION [X]. Legislative Authority of Citizens.
(a) DECLARATION OF AUTHORITY.
All political power being inherent in the people, the citizens of Florida retain and may exercise direct legislative authority over all matters of government and all elected officials at every level. This authority is fundamental, inalienable, and superior to all statutory law.
(b) THREE POWERS OF CITIZENS.
The legislative authority of citizens shall include, but not be limited to, the following powers which may be exercised by the electorate of any jurisdiction:
(1) DIRECT VOTING POWER. Citizens shall have the right to vote directly on any proposed legislation, ordinance, rule, or regulation that would affect fifty-one percent (51%) or more of the population within the jurisdiction.
(2) AUTHORITY TO TASK OFFICIALS. Citizens shall have the right to direct any elected official to propose, draft, and advocate for specific legislation addressing matters of public concern. Upon petition signed by thirty percent (30%) of registered voters, the official must introduce the requested legislation within 60 days.
(3) RECALL ELECTIONS. Citizens shall have the right to remove any elected official, at any level of government, through recall election.
(e) SUPREMACY CLAUSE.
This section supersedes all conflicting provisions of statutory law, including but not limited to Florida Statutes Section 100.361 and any other law purporting to limit or regulate citizen recall, initiative, or referendum. In the event of conflict between this section and any statute, this constitutional provision shall control.
